Definitions
For the purposes of these Terms of Service, the following definitions apply:
Services Overview
iSetupClaw provides professional claw machine setup, optimization, and operator training services delivered remotely. Our services include, but are not limited to:
- Remote Machine Setup: Live guided configuration of claw machine settings including claw strength, timing, payout ratios, voltage calibration, and sensor tuning.
- Prize Placement Strategy: Expert guidance on optimal prize arrangement, sizing, and selection to maximize player engagement and profitability.
- Operator Training: One-on-one video training sessions covering machine operation, maintenance, prize sourcing, and business strategies.
- Ongoing Support: Email and messaging-based support for troubleshooting, seasonal adjustments, and performance optimization during the support period included in your plan.
- Performance Reviews: Scheduled reviews of machine performance data with recommendations for improvement (available in Pro and Business plans).
All services are delivered remotely. We do not provide on-site visits or physical installation services. The Client is responsible for having physical access to their machine(s) and the ability to make manual adjustments as directed during remote sessions.
Pricing & Payment
3.1 Service Plans
We offer three service tiers, each with a one-time payment:
- Quick Setup: $297 USD â Single machine remote setup with 7 days email support.
- Pro Setup: $597 USD â Up to 3 machines with training and 30 days priority support.
- Business Plan: $1,497 USD â Up to 10 machines with full training program and 90 days priority support.
3.2 Payment Terms
- All prices are listed in United States Dollars (USD).
- Payment is required in full before services are rendered.
- Payments are processed through our authorized third-party payment processor. We do not store your credit card or payment information on our servers.
- By completing a purchase, you confirm that you are authorized to use the payment method provided.
3.3 Taxes
Prices listed may not include applicable taxes, duties, or fees imposed by your local jurisdiction. You are responsible for any such charges that may apply to your purchase.
3.4 Plan Upgrades
Clients may upgrade from a lower-tier plan to a higher-tier plan at any time. The amount previously paid will be credited toward the cost of the upgraded plan. Downgrades are not available after services have been initiated.
Refund Policy
We stand behind the quality of our services. If you don't see measurable improvement in your machine's performance within 30 days of your setup session, we will either re-optimize your machine at no additional cost or issue a full refund.
4.1 Eligibility for Refund
To be eligible for a refund under our satisfaction guarantee, the following conditions must be met:
- You must have completed the full remote setup session as scheduled.
- You must have implemented all recommended settings and configurations as directed during the session.
- You must submit your refund request within 30 calendar days of the completed setup session.
- You must provide reasonable evidence that the recommended settings were applied and maintained.
4.2 Non-Refundable Scenarios
- The Client failed to attend or complete the scheduled setup session without prior notice.
- The Client did not implement the recommended settings or made unauthorized modifications.
- Machine performance was affected by external factors beyond our control (e.g., machine malfunction, location closure, power issues, vandalism).
- The refund request is submitted more than 30 days after the completed session.
- The Client has previously received a refund from iSetupClaw for a different purchase.
4.3 Pre-Service Cancellation
If you wish to cancel your purchase before any services have been delivered, you are entitled to a full refund minus any applicable payment processing fees. Cancellation requests must be submitted via email to hello@isetupclaw.com.
4.4 Refund Processing
Approved refunds will be processed within 7-10 business days through the original payment method. Depending on your bank or payment provider, it may take an additional 5-10 business days for the refund to appear on your statement.
Service Delivery
5.1 Scheduling
After your purchase is confirmed, we will contact you within 24 hours (during business days) to schedule your remote setup session at a mutually convenient time. Sessions are available Monday through Saturday, 9:00 AM to 8:00 PM EST.
5.2 Session Requirements
For a successful remote session, the Client must ensure:
- Physical access to the claw machine(s) during the scheduled session time.
- A smartphone, tablet, or laptop with a working camera and stable internet connection.
- The ability to make manual adjustments to the machine as directed.
- Any necessary tools as communicated prior to the session (typically a screwdriver and access keys).
5.3 Rescheduling & No-Shows
- Clients may reschedule a session with at least 24 hours' notice at no additional charge.
- Sessions may be rescheduled up to two (2) times. After the second reschedule, a $50 rescheduling fee may apply.
- If the Client fails to attend a scheduled session without prior notice ("no-show"), the session will be considered delivered, and no refund will be issued.
5.4 Support Periods
Each plan includes a defined support period beginning on the date of the completed setup session:
- Quick Setup: 7 calendar days of email support.
- Pro Setup: 30 calendar days of priority email and messaging support.
- Business Plan: 90 calendar days of priority support with scheduled performance reviews.
Support requests submitted after the expiration of your support period may be addressed at our discretion or may require the purchase of additional support.
Client Responsibilities
By purchasing our services, you acknowledge and agree to the following responsibilities:
- Accurate Information: You will provide accurate and complete information about your machine model, location, current settings, and business goals.
- Machine Access & Ownership: You represent that you are the legal owner or authorized operator of the claw machine(s) submitted for setup.
- Implementation: You are responsible for physically implementing all settings adjustments as directed during remote sessions.
- Compliance: You are responsible for ensuring that your claw machine operation complies with all local, state, and federal laws, regulations, and licensing requirements.
- Maintenance: You are responsible for the ongoing maintenance and physical condition of your machine(s).
Claw machine regulations vary by state and locality. Some jurisdictions classify claw machines as amusement devices while others may classify them as games of chance. It is solely your responsibility to understand and comply with the laws in your area. iSetupClaw does not provide legal advice.
Intellectual Property
7.1 Our Content
All content provided through our services â including but not limited to training materials, strategy documents, optimization guides, templates, and performance tracking tools â is the intellectual property of iSetupClaw and is protected by copyright and other intellectual property laws.
7.2 License Grant
Upon purchase, we grant you a limited, non-exclusive, non-transferable license to use the materials provided for your own personal or business use. You may not:
- Reproduce, distribute, or share our materials with third parties.
- Resell, sublicense, or commercially exploit our content or strategies.
- Use our materials to create a competing service or product.
- Record remote sessions without our prior written consent.
7.3 Trademarks
The iSetupClaw name, logo, and all related branding elements are trademarks of iSetupClaw. You may not use our trademarks without prior written permission.
Limitation of Liability
To the maximum extent permitted by applicable law:
- No Guarantee of Specific Results: While we have a strong track record, we do not guarantee specific revenue amounts, profit margins, or business outcomes. Results vary based on numerous factors.
- Maximum Liability: Our total aggregate liability shall not exceed the total amount you paid for the specific service plan giving rise to the claim.
- Exclusion of Damages: In no event shall iSetupClaw be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.
- Third-Party Actions: We are not liable for actions of third parties, including payment processors, video call platforms, machine manufacturers, or location owners.
- Equipment Damage: We are not liable for any physical damage to your claw machine(s) during or after implementation of our recommendations.
Disclaimers
Our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Any warranty that our services will be uninterrupted, error-free, or available at all times.
- Any warranty regarding the accuracy or completeness of any advice or information provided.
9.1 Revenue & Income Disclaimer
Any revenue figures, earnings examples, or income projections mentioned on our website or during consultations are for illustrative purposes only. They represent potential outcomes based on past experience but are not guarantees. Your individual results will depend on factors unique to your situation.
9.2 Not Professional Advice
Our services constitute business consulting specific to claw machine optimization. Nothing we provide should be construed as legal, financial, tax, or accounting advice.
Confidentiality
10.1 Your Information
Any business information, revenue data, machine settings, or personal details you share with us will be treated as confidential. We will not disclose your information to third parties without your consent, except as required by law.
10.2 Our Methods
The specific optimization techniques, strategies, and proprietary methods shared during our sessions are confidential trade secrets of iSetupClaw. You agree not to disclose or teach our specific methods to third parties or competitors.
10.3 Testimonials & Case Studies
We may request your permission to use your results or feedback in our marketing materials. Participation is entirely voluntary. We will never use your name or specific data without your explicit written consent.
Termination
11.1 By the Client
You may terminate the service engagement at any time by providing written notice to hello@isetupclaw.com. Refund eligibility will be determined in accordance with Section 4 (Refund Policy).
11.2 By iSetupClaw
We reserve the right to terminate or suspend our services to any Client if:
- The Client engages in abusive, threatening, or disrespectful behavior toward our team.
- The Client provides false or misleading information.
- The Client violates any provision of these Terms of Service.
- The Client uses our services or materials for unlawful purposes.
- Continued service delivery is impractical due to circumstances beyond our control.
In the event of termination by iSetupClaw due to Client misconduct, no refund will be issued.
Governing Law & Dispute Resolution
12.1 Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.
12.2 Dispute Resolution
In the event of any dispute arising from or relating to these Terms:
- Informal Resolution: Both parties agree to first attempt to resolve any dispute informally by contacting us at hello@isetupclaw.com. We commit to responding within 5 business days and engaging in good-faith negotiations for at least 30 days.
- Binding Arbitration: If informal resolution fails, any dispute shall be resolved through binding arbitration conducted online or in the State of Delaware.
- Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.
Changes to These Terms
We reserve the right to modify, update, or replace these Terms of Service at any time. When we make changes:
- The "Last Updated" date at the top of this page will be revised.
- Material changes will be communicated via email to existing clients with active service plans.
- Continued use of our services after the effective date of any changes constitutes your acceptance of the updated terms.
We encourage you to review these Terms periodically. If you disagree with any changes, your sole remedy is to discontinue use of our services.
